I am trying Flexibility on a second site now and upon install receivied the following error:
Fatal error: Call to undefined function is_front_page() in /home/daytradi/public_html/wp-content/themes/flexibility2/index.php on line 10
Dont know what to do from here?

Try reinstalling the theme, but it sounds like a WP issue to me, not a theme issue. The is_front_page function does not through an error in WP if it is installed properly.
